THE CONTRACTOR’S AND CUSTOMER’S LIABILITY FOR ENVIRONMENTAL CRIME: A RECENT JUDICIAL ARREST IN COMPLIANCE WITH THE MOST STRICT GUIDELINES

The contribution of Avv. Mario Arienti entitled “The contractor’s and client’s liability for environmental crime: a recent jurisprudential arrest in accordance with the most rigorous orientation”. Starting from a recent ruling by the Supreme Court of Cassation (Cass., section III, sentence 21 June 2022, n. 34397), the contribution explores the jurisprudential contrast relating to the classification of the responsibility of the client for environmental crimes committed by the ‘contractor. A matter of great practical importance for companies and individuals who award tender assignments with environmental or waste disposal implications (e.g. construction sites, industrial cleaning, etc.).
